Microdoc Terms of Use

1. Introduction
Welcome to Microdoc! These Terms of Use ("Terms") govern your access to and use of Microdoc's services, software, and related applications ("Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use Microdoc.
2. Definitions
- Microdoc refers to the company, its software, and related services.
- User refers to any individual or entity using Microdoc's Services.
- Healthcare Provider refers to individual doctors, clinics, hospitals, or other entities using the Services for medical documentation.
- AI-Generated Content refers to documentation generated through Microdoc's AI-powered dictation service.
3. Eligibility
Microdoc is intended for licensed healthcare professionals and authorized personnel. By using Microdoc, you confirm that:
- You are at least 18 years old.
- You are a licensed healthcare provider or authorized representative of a healthcare organization.
- You will use the Services in compliance with applicable laws and regulations.
4. License and Use Restrictions
Microdoc grants you a limited, non-exclusive, non-transferable license to use the Services for medical documentation purposes. You agree that:
- You will not reverse-engineer, copy, modify, distribute, or sell any part of Microdoc.
- You will not use the Services for unlawful, fraudulent, or unethical purposes.
- You will not attempt to access, extract, or manipulate AI-generated outputs beyond intended use.
- You will ensure compliance with data protection laws when inputting patient information.
5. AI-Generated Content and Limitations
Microdoc uses AI to generate medical documents, which:
- Are intended as assistive tools and not a substitute for professional medical judgment.
- Must be reviewed, verified, and edited by a licensed healthcare professional before use.
- May occasionally produce errors, and Microdoc is not responsible for inaccuracies or misinterpretations.
6. Data Security and Privacy
Microdoc prioritizes data security and compliance with applicable regulations, including GDPR and HIPAA (where applicable). By using Microdoc:
- You acknowledge that patient data must be handled in accordance with legal and ethical guidelines.
- You are responsible for implementing adequate safeguards when sharing or storing generated content.
- You agree to Microdoc's Privacy Policy, which governs data collection, processing, and security measures.
7. Service Availability and Downtime
Microdoc aims for high reliability but does not guarantee uninterrupted service. We reserve the right to:
- Perform scheduled maintenance and updates.
- Temporarily suspend access for security or operational reasons.
- Modify or discontinue parts of the Services at any time.
8. Fees and Payment
Microdoc operates on a subscription basis. By subscribing:
- You agree to pay fees as outlined in your pricing plan.
- Failure to pay may result in suspension or termination of access.
- Fees are non-refundable unless explicitly stated otherwise.
9. Liability and Disclaimers
- Microdoc does not provide medical advice. AI-generated documentation is an assistive tool and must be reviewed before reliance.
- Microdoc is not liable for clinical decisions, patient outcomes, or errors resulting from reliance on AI-generated content.
- Microdoc is provided "as is" without warranties of any kind, express or implied.
- To the fullest extent permitted by law, Microdoc's liability is limited to the amount paid by the User in the past six (6) months.
10. Termination and Suspension
Microdoc may suspend or terminate access if:
- A User violates these Terms.
- There is misuse, unauthorized access, or security concerns.
- A User ceases payment for services.
Users may terminate their account by providing written notice. No refunds will be issued upon termination unless otherwise stated.
11. Indemnification
You agree to indemnify and hold harmless Microdoc from any claims, damages, losses, liabilities, and expenses arising from:
- Misuse of the Services.
- Violation of applicable laws or regulations.
- Any reliance on AI-generated medical documentation.
12. Dispute Resolution
Any disputes arising under these Terms will be:
- Governed by the laws of Ireland.
- Resolved through negotiation, and if necessary, arbitration in Ireland.
13. Changes to Terms
Microdoc reserves the right to update these Terms at any time. Users will be notified of significant changes, and continued use of the Services constitutes acceptance of the revised Terms.
By using Microdoc, you acknowledge that you have read, understood, and agree to these Terms.
